It's not legal what they do, as they did not get OK from you. Also, you should consider such probabilities -among many others- that a) if they are trying to use it in a way to earn money for themselves (that would be contrary to the limited license allowed by THQ) and also, even more importantly they may actually infect the files with trojan/viruses and thus infect those computers which download from there.
By the rule of thumb, you should never allow any unauthorized and unverifiable parties (those particularly in the business of money making) to extend their hands and noses uninvited. Always suspicious.
--verifiable means is not that they are just over there on the internet and we see them. Everyone is on the internet, absolutely everyone there. People need to be trusted deservedly. And those who deserve such trust do not do such things in the first place.
Warn them seriously and immediately, at this first stage, if you ask my opinion. IMO, they have already forfeited any trust that might've been otherwise put on them, so ask them remove the file and do not deal with them.
